TERMS AND CONDITIONS E-LEARNING COURSES - 13.05.2022
By registering, the following terms and conditions for flexible e-learning courses are accepted as the basis of the legal relationship between the participant and Graduate Campus Hochschule Aalen GmbH.
1. REGISTRATION AND COURSE BOOKING, LOSS OF THE RIGHT OF WITHDRAWAL
[1] Registrations are made by using the registration form at www.learniac.org. I explicitly agree that the execution of the contract will begin before the expiry of the cancellation period. I confirm that I am aware that I will lose my legal right of withdrawal upon the fulfilment of the contract by the entrepreneur.
[2] Graduate Campus will send a confirmation of the registration by an automatically generated email immediately after receipt of the registration. This concludes the contract.
The login data will be sent by email immediately after receipt of payment or confirmation of payment by the service provider processing the payment.
2. TERMS OF PAYMENT
[1] The participant commits to full payment of the participation fee at the time of the course booking.
[2] Payments can be made in the ways indicated at the time of booking.
3. ACCESS TO THE COURSES AND THEIR CONTENT
[1] After receiving the log-in data, the booked materials/courses can be accessed for a period of 90 days.
[2] The contents offered in the courses serve the purpose of further personal education and information on the respective subject areas.
[3] The courses do not constitute proof of (acquired) qualifications in the context of a university education.
4. DATA PRIVACY / COPYRIGHTS
[1] By registering, the participant agrees that personal data may be stored for the purpose of processing the contractual relationship, payment and later participation information, e.g. for evaluations, and may also be passed to Aalen University for the purpose of certificate creation. Furthermore, Graduate Campus commits itself to the protection of data privacy.
[2] Graduate Campus provides various information/documents within the scope of the online offer. The teaching materials, learning materials and accessible contents are only made available to the participants for the purpose of self-study. In this context, they may be freely used and utilized. The participants are obligated to Graduate Campus Hochschule Aalen GmbH not to reproduce, distribute, make available to the public, or in any other way exploit the materials and content provided within the scope of the course without the consent of Graduate Campus Hochschule Aalen GmbH.
5. LIABILITY
[1] Graduate Campus is liable for damages in cases of intent or gross negligence on the part of a representative or vicarious agent, as well as in cases of physical and health damages caused by carelessness, in accordance with the statutory legislation. Apart from that, liability exists only according to the Product Liability Act or due or for culpable breach of essential contractual duties or insofar as a guarantee or procurement risk has been assumed. Liability also exists if a defect was fraudulently concealed. The claim for damages for culpable violation of essential contractual obligations is limited to the foreseeable damage typical for the contract.
[2] The provisions of the above paragraph shall apply to all claims for damages, and irrespective of the legal grounds. Any liability beyond this is excluded.
[3] No change in the onus of proof to the disadvantage of the customer is associated with the preceding paragraphs.
6. PLACE OF JURISDICTION / APPLICABLE LAW
[1] Where legally permissible, Aalen is agreed as the place of jurisdiction.
[2] German law applies exclusively for the contractual relationship.
7. RIGHT OF WITHDRAWAL
[1] Right of withdrawal
You have the right to withdraw from the contract within a period of 14 days, without giving a reason by giving a written notice (e.g. letter, e-mail). The term starts with the receipt of this instruction, but not before the conclusion of the contract and also not before we have fulfilled our information obligations pursuant to Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB. In order to observe the revocation period, the timely dispatch of the revocation is sufficient. The revocation is to be sent to:

[2] Consequences of withdrawal
In the case of an effective revocation the mutually received benefits are to be returned and if so derived profits are to be returned.
In case you are unable to reimburse us either in total or partially for services received, you are required to offer a compensation of equal value. This may result in you nevertheless having to satisfy the contractual payment obligations for the period up until revocation. You are obliged to refund any open payments within 30 days after sending off your withdrawal notice. For you, the period begins on submission of the declaration of withdrawal and for us upon receipt of the same.
Your right of withdrawal shall expire prematurely if the agreement, at your express request, has been executed in full by both parties prior to your exercising your right of withdrawal.
